CONSENT TO REMOTE ACCESS

You hereby understand, acknowledge and agree that in order for NorthernTel technicians to provide you with the highest quality of service in relation to ADVANCED HELP ONLINE , they may need to have remote access to your computer, in which case they may have access to all information, data, software and generally all files stored on your computer. You therefore hereby agree to grant them such full remote access in order to enable them to provide you with the highest quality of service in relation to ADVANCED HELP ONLINE . The remote access to your computer will be conducted under your constant supervision, as you will visualize on your screen the work conducted by NorthernTel technicians, and you will thereby be able to end the remote access at all times.

ONLINE SERVICES

Due to the complexity of issues you may face, ADVANCED HELP ONLINE is a “best effort” service and does not guarantee resolution of the problem. If your problem should prove too complex according to NorthernTel technicians to be reasonably resolved by way of telephone, online support or distant access by internet, they may (i) recommend the best course of action and may, to the extent possible, provide manufacturer contact information for the product or issue in question, or they may (ii) reserve the right, at their discretion, to end their assistance in order to resolve the problem. NorthernTel does not guarantee notably the performance, availability, accuracy, security, error free, or uninterrupted operation or use of ADVANCED HELP ONLINE, or that the services provided in relation thereto will meet your requirements or expectations.

EXCLUDED SERVICES

ADVANCED HELP ONLINE is not (i) an all-inclusive PC support service, (ii) an on-site service, (iii) intended to replace the more advanced technical support that may be available from hardware or software manufacturers, (iv) intended to provide exhaustive training in hardware or software usage, or (v) intended to provide you with constant or unlimited access to, or assistance from, our specially trained representatives.

LIMITATION OF LIABILITY

AS AN ESSENTIAL CONSIDERATION FOR NorthernTel TO ENTER INTO THIS AGREEMENT WITH YOU, YOU EXPRESSLY UNDERSTAND AND AGREE THAT UNDER NO CIRCUMSTANCES SHALL NorthernTel OR ANY OF ITS SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION ANY GENERAL, DIRECT, INDIRECT, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY DAMAGES FOR LOSS OF USE OR LOSS OF DATA, ON ACCOUNT OF ANY ACT OR OMISSION OF NorthernTel OR ITS REPRESENTATIVES RELATED IN ANY WAY TO THE SERVICES RENDERED THROUGH ADVANCED HELP ONLINE OR THIS AGREEMENT. THIS SECTION SHALL APPLY: (A) REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, EXTRA-CONTRACTUAL LIABILITY (INCLUDING NEGLIGENCE) OR OTHERWISE; AND (B) WHETHER OR NOT DAMAGES WERE FORESEEABLE.
